Over the past two years, the Australian Patent Office has worked with a committee of representatives of NGOs, to review the privilege provisions afforded to the clients of Australian patent and trade marks attorneys following recent decisions in Australian courts where privilege was denied.

On 3 September 2009, the Full Federal Court of Australia handed down its appeal decision in University of Western Australia v Gray ([2009] FCAFC 11). This was an appeal from a decision of the Federal Court given on 17 April 2008.

In 2002, the Australian Government of the day introduced an American style Grace Period into the Australian Patents Act, giving applicants a degree of protection against loss of rights due to disclosure before their patent application is filed.
Chris Owens has close to 30 years experience protecting inventions in the fields of electrical and mechanical engineering, with particular interest in silicon device fabrication, photovoltaics, analog and digital electronics, IT, industrial process and control, image processing, mineral exploration instrumentation and mechanical mining and processing systems.
 
As a partner of the firm Chris has a keen interest in fostering the culture of strong client relationships and he leads by example, with several collaborations with clients extending over 25 years.  Chris works with a diverse group of clients ranging from large multi-national corporations through to individual inventors and prides himself on deep relationships with each.
 
Managing IP's 2011 annual survey of IP firms included the following statement about Chris:
 
'In Sydney, Chris Owens and his team look after the filing of the majority of University of New South Wales' patents on photovoltaic engineering.'
 
Before joining FB Rice, Chris worked in areas of industry related to his specialties.  This industry experience enables him to really appreciate an engineer’s perspective and get to the root of an invention, rather than simply protect the embodiment of a broader concept.
 
He has extensive experience in the drafting of original patent specifications and filing and prosecution of patent applications in US and Europe for both US and Australian clients.
