Toby Thompson – Senior Associate

Toby Thompson supports clients in the areas of pharmaceuticals, animal healthcare, agribusiness, polymers, industrial organic chemistry, materials, food and beverage technology, and consumer health products, by providing them with relevant advice regarding their IP. Toby is based in our Melbourne office as a senior associate in the Chemistry team and is experienced in many aspects of patent work (including drafting applications and patent prosecution strategy/portfolio management), however a significant proportion of his practice involves conducting clearance searches, providing FTO advice, opposition work and litigation support. Toby has been recognised as an MIP Rising Star 2019.


Full Bio

Toby has worked in patents for 12 years and qualified as a European and UK patent attorney alongside being an AU/NZ patent and trade mark attorney. He is focused on providing relevant advice to clients, and ensuring that their IP strategy is aligned with commercial goals.

During his time working in Europe, as well as gaining extensive experience in patent drafting and prosecution before the European Patent Office (EPO), Toby also acquired expertise in patent term extensions and Supplementary Protection Certificates (SPCs), through handling various UK SPC cases and a pan-European SPC filing programme.

Before moving into intellectual property Toby spent five years working in pharmaceutical R&D for a multinational pharmaceutical company. He initially worked in medicinal chemistry research and played a principal role in identifying two candidate drugs based on knowledge of synthetic organic chemistry, SAR, DMPK and pharmaceutical safety issues. Subsequently, Toby led a group providing large scale quantities of candidate drugs for preclinical safety studies, and carrying out synthetic route development work to support drug discovery projects. Toby is named as an inventor on seven patent families.

Toby presents regularly on IP, and since 2018 has delivered the IP module in an RMIT Entrepreneurship course for PhD students, together with colleagues. Whilst working in Europe he developed a one-day workshop on IP for biotech/pharma start-ups and tech transfer organisations at the Karolinska Institute in Sweden. Toby was also a lecturer in Advanced Medicinal Chemistry at Nottingham Trent University, UK, during his time working in research.
