FB Rice Pty Ltd and FB Rice (NZ) Limited (together, ‘FBR’, or ‘we’, ‘us’, ‘our’) respect the privacy rights of all individuals with whom they conduct business, comply with all their obligations under the following privacy laws, as applicable (‘Privacy Laws’):

in Australia, the Privacy Act 1998 as amended by the Privacy Amendment (Enhancing Privacy Protection) Act 2012 including the 13 Australian Privacy Principles (APPs) as set out in the Privacy Act 1998; and
in New Zealand, the Privacy Act 2020, including the 13 information privacy principles (‘IPPs’).

This privacy policy discloses the way in which we collect, use and protect any personal information you provide to us.

Types of personal information that we collect and how we use it

FBR collects personal information about individuals where this information is necessary or desirable to carry out our business activities as Patent and Trade Mark Attorneys.

The personal information we collect depends on our relationship with you and may include:

your name;
your date and place of birth;
your phone number, facsimile number, residential address and email address;
bank account details and credit / debit card details;
any information or comments provided by you; and
any other personal information that you disclose or that is otherwise made available to us in connection with our provision of services to you.

This information is used to:

provide advice in relation to Intellectual Property (IP);
file and prosecute Intellectual Property applications in Australia, New Zealand and overseas;
conduct opposition proceedings in Australia, New Zealand and overseas;
conduct watches and searches;
provide correspondence and newsletters to you as our client, regarding developments in IP law; and
otherwise in connection with the provision of services to you.

We may also use your personal information to conduct credit checks on you, and may disclose your personal information to credit checking agencies to enable us to do so.

You may decide not to provide your Personal Information to us. However, without access to your personal information, we may not be able to provide you with access to our services.

Manner of collection of personal information

Wherever reasonably practicable FBR collects personal information directly from the individuals concerned. Where the information is not obtained from an individual, personal information is obtained in accordance with the Privacy Laws.

If, at any time, you provide us with personal information or information about some other than yourself, you warrant to us that you have that person’s consent to provide such information for the purpose specified and for us to treat such information in accordance with this privacy statement.

When visiting the FBR website, our Internet Service Provider (‘ISP’) may collect the following information for statistical purposes:

Server address;
Top level domain name;
Time and date of visit and pages accessed;
Type of browser being accessed;
When you send us an email or contact us using our E-office or Contact Us facility, your email address will be collected and used only for the purpose for which you have provided it.

Please note that our website does not provide facilities for secure transmission of information across the Internet. Our website only uses session cookies and only during a search query of the website. Our ISP advises that no cookies are employed on this website except for those associated with the search engine.

Disclosure of personal information

The personal information held by FBR is generally kept confidential.

We may, however, disclose personal information:

between us (that is, between FB Rice Pty Ltd and FB Rice (NZ) Limited);
to government offices, such as IP Australia or IPONZ;
to other third parties, such as our service providers, agents and associates overseas, where we consider that it is reasonably required in connection with the provision of our services to you;
to our clients (where information has been provided to us by someone other than our client);
if we are required to do so by law; and
where we are otherwise permitted to do so under Privacy Laws.

FBR does not make available any personal information to any other person or organisation for direct marketing purposes.

FBR has security measures designed to protect against the loss, misuse and/or alteration of personal information under its control and takes reasonable steps to prevent unauthorised access or modification or disclosure of personal information.

Correcting and updating personal information

FBR makes reasonable efforts to ensure that any personal information collected, used or disclosed is accurate, complete and current. Please advise us if your personal information changes to help us ensure that the information we hold is up to date, complete, relevant and not misleading.

We will provide you with details of the personal information collected about you, at your request. Normally there will not be a charge for responding to such a request unless we incur costs in providing the information.
