A registered design gives to the owner of the design a monopoly right in respect of the appearance of a product embodying that design. The monopoly is a statutory monopoly and does not require the owner of the design to establish that their design has actually been copied. In Australia, and in many other countries, third parties are able to reverse engineer and copy products which have been commercialised and marketed, unless those products are protected by a registered design (or patent). If the product is not patentable a registered design provides a way for a designer to protect the investment they have made in product design. In many countries designs which have not traditionally been considered as products as such, such as GUIs and electronic typefaces are registrable as designs.
